Dunn Carney attorneys Jack Cooper and David Rossmiller successfully assisted a client in a recent hard-fought battle over noncompetition restrictions. The case presented a host of interesting issues, including application of the so-called “unclean hands” doctrine and whether an employer can be prevented from enforcing such a restriction because of statements made to an employee at the time of signing. The matter also emphasized the importance of employers in Oregon being in full compliance with 2008 changes in the law relating to the enforceability of noncompetition provisions. Dunn Carney has a long history of specialized expertise in noncompetition matters in all stages of the process, from implementation to ultimate enforcement.
