March 4---AGC University--Oregon-Columbia Chapter-- Bill Joseph will speak on Getting Paid: Oregon Construction Liens-Private Work at the AGC Center in Wilsonville. 
Oregon lien law is one of the most effective in the country and arguably the best protection a contractor can have for getting paid. Yet the lien process is fraught with pitfalls that can invalidate an otherwise meritorious lien claim. Dunn Carney attorneys Jack Cooper and David Rossmiller successfully assisted a client in a recent hard-fought battle over noncompetition restrictions.  The case presented a host of interesting issues, including application of the so-called “unclean hands” doctrine and whether an employer can be prevented from enforcing such a restriction because of statements made to an employee at the time of signing.  The matter also emphasized the importance of employers in Oregon being in full compliance with 2008 changes in the law relating to the enforceability of noncompetition provisions.  Dunn Carney has a long history of specialized expertise in noncompetition matters in all stages of the process, from implementation to ultimate enforcement.
